Unpaid Assessments:  When to Go to the Mattresses

Presented by: Donna M. Mason

Sollozzo:  “I don’t like violence, Tom, I’m a businessman; blood is expensive.”  And so is litigation.   Associations trying to weather The Great Recession need to know when to make peace (write-off or settle) and when to go to the mattresses.  Protecting an assessment policy is important, but a business plan is also critical.  Review the factors for taking—and continuing—legal action with our collection consigliere and be able to confidently reply to any member who questions your motives…”It’s not personal…It’s strictly business.”

The Dysfunctional Family:  Directors Who Air the Family’s Dirty Laundry

Presented By: Aimée T.H. Kessler

When are Board discussions and documents “protected”?  What books and records must be shared with the members?  And what do you do about the director that leaks information concerning the family business?  Is it time to call a “button man” or does the Board need a majority vote of the members first?

Water Damage: Sleeping with the Fishes

Presented by: Robert J. Segan

Condominium boards and homeowner association boards have different nightmares.  One board fears water dripping from the ceiling and the other board shudders to think of water (or worse) flowing from the common area and into a member’s basement.  The common question:  Who gets financially soaked for the damage?   And what do tree roots have to do with it?   Review fact scenarios—and recommendations—with our professor of trickle down leak-economics.

Racing Forum:  Legislative Update 2010 – Lions, Tigers and Gorillas, Oh My!

Presented by: William B. Mason, Jr. and Kimberly Ferrari

No seriously…just gorillas (Senate Bill No. 570), plus…solar panels, clothes lines, nonjudicial lien foreclosures, storm water system liabilities, meetings, notices and voting, fair housing education, flags, the Ombudsman, resale fees, FHA and FNMA underwriting, resident noise, developer control, covenant charges and assessment debt reduction.

Business Judgment Rule

Presented by: Elizabeth M. Crego

Having concluded that the Board acted reasonably, one local judge stated, “I cannot substitute my judgment for their judgment…It is not so obviously safe, in harmony with external design…to make it a matter upon which reasonable persons could not differ.”   With that decision, the “business judgment rule” became part of the Northern Virginia territory…only to be carved up with an exception at seemingly every corner.  What protection is it now for the Board in the operation of the family business?

Unfinished Business:  Left Holding the (Developer’s) Bag

Presented by: Jennifer Lynn Epler

And not the “money bag” either.  The Developer never promised you a rose garden—but…sod and grass around the rose garden, sidewalks and trees—those were definitely all part of the plan…part of the promise.  Now comes The Great Recession and the flow of money has dried up.  The residents have taken over an association with financial assets of “not much”.  What are your options?
